Terms of Service

1. Agreement and eligibility

These Terms govern your use of VibeMatch, which is operated by Wheeler Innovation Group LLC. By creating an account or using the service, you agree to these Terms and the Community Guidelines. When signup presents an agreement control, you must affirm that agreement before creating the account. Users must be at least 18 years old and legally capable of entering into a binding agreement. VibeMatch is designed primarily for adults 35+, but users under 35 are not prohibited if they meet the legal eligibility requirements.

2. The service

VibeMatch is a technology platform that allows adults to discover, communicate with, and potentially meet other users. Wheeler Innovation Group LLC and VibeMatch do not guarantee matches, dates, relationships, compatibility, identity, intentions, conduct, safety, or the accuracy of information provided by users.

Unless expressly stated for a particular feature, VibeMatch does not conduct or guarantee criminal background checks, sex-offender registry checks, employment verification, financial verification, address verification, or comprehensive identity verification.

3. User responsibility and prohibited conduct

Users communicate with and meet other users at their own discretion and risk. VibeMatch does not arrange, supervise, attend, control, or guarantee in-person meetings or conduct occurring outside the service. Users remain responsible for exercising reasonable judgment and personal-safety precautions when communicating with or meeting another person.

You must provide accurate information, protect your account, respect others, and follow the Community Guidelines and applicable law. You may not harass, stalk, threaten, intimidate, extort, blackmail, impersonate, defraud, doxx, exploit, or unlawfully discriminate against another person. You may not send non-consensual sexually explicit content or reveal another person's private information or private media without permission.

If another member unmatches you, blocks you, or asks you to stop contacting them, you must respect that boundary. You may not create or use duplicate or replacement accounts to bypass a member block, feature restriction, suspension, or account termination.

4. Reports, moderation, enforcement, and termination

VibeMatch may investigate reports and may warn, remove content, restrict features or visibility, suspend accounts, or terminate accounts when reasonably necessary to enforce its rules, protect users, prevent fraud or abuse, comply with law, or protect the service. Serious, repeated, fraudulent, threatening, or circumvention-related violations may result in permanent account termination.

VibeMatch does not guarantee continuous monitoring, pre-screening, or supervision of all member activity or private communications, and does not guarantee that every harmful act will be detected or prevented.

When reasonably necessary to respond to credible threats, emergencies, suspected fraud or abuse, or valid legal process, VibeMatch may preserve and disclose relevant account or content information as permitted or required by applicable law and the Privacy Policy.

You may stop using the service at any time. VibeMatch may suspend or terminate access for violations of these Terms or the Community Guidelines, risks to users or the service, legal requirements, or discontinuation of the service. Provisions that by their nature should survive termination will remain in effect, including provisions concerning responsibility, disclaimers, liability, governing law, and dispute-related rights.

5. Disclaimer of warranties

VibeMatch and its services are provided “AS IS” and “AS AVAILABLE” to the fullest extent permitted by law, without guarantees that the service will always be uninterrupted, error-free, completely secure, or produce any particular romantic or social outcome.

6. Acts of other users

To the fullest extent permitted by applicable law, Wheeler Innovation Group LLC, VibeMatch, its owners, officers, employees, contractors, affiliates, and agents are not responsible for the acts or omissions of users, including fraud, scams, harassment, stalking, theft, robbery, assault, sexual misconduct, coercion, kidnapping, property damage, personal injury, or other criminal or harmful conduct committed by another person.

7. Limitation of liability

To the fullest extent permitted by law, Wheeler Innovation Group LLC is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of VibeMatch or interactions with other users.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from gross negligence, fraud, willful misconduct, or other nonwaivable rights under applicable law. These Terms do not eliminate every form of legal liability.

8. Changes to these Terms

VibeMatch may modify these Terms from time to time. If a change is material, VibeMatch will provide reasonable notice through the service or another appropriate method before the change takes effect, unless immediate changes are reasonably necessary for legal, security, or abuse-prevention reasons. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law. If you do not agree, you must stop using the service.

9. Michigan governing law, venue, and consumer rights

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except where the law of your place of residence requires otherwise. To the extent a forum selection provision is enforceable, a court proceeding arising from these Terms or use of VibeMatch must be brought in a state or federal court located in Wayne County, Michigan, unless applicable law requires another forum.

Nothing in these Terms limits mandatory, nonwaivable consumer rights or remedies, including rights that may apply under the Michigan Consumer Protection Act, MCL 445.901 et seq., or other applicable consumer-protection law.

10. User content, moderation, and legal protections

VibeMatch hosts user-generated profile information, messages, photos, and other member content and may moderate or restrict such content in good faith under these Terms and the Community Guidelines. Nothing in these Terms is intended to waive any defense, immunity, or protection available to VibeMatch or Wheeler Innovation Group LLC under 47 U.S.C. § 230 or other applicable law. This provision does not expand any statutory protection beyond what the law provides.

11. Paid features and refunds

If VibeMatch offers paid subscriptions, credits, or other paid features, the price, renewal, cancellation, and refund terms shown at purchase will apply. Account moderation or enforcement does not by itself create a right to a refund. Nothing in these Terms removes a cancellation, refund, or reimbursement right that cannot legally be waived under applicable Michigan, federal, or other controlling law.

12. Severability and entire agreement

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted or modified only as needed, and the remaining provisions will continue in effect. These Terms, together with policies and rules expressly incorporated by reference, are the entire agreement between you and Wheeler Innovation Group LLC regarding VibeMatch and replace prior agreements or understandings about the service. A failure to enforce a provision is not a waiver of the right to enforce it later.
